1. About GiveGiftAid
GiveGiftAid (givegiftaid.uk) is operated by Liam Burt, a sole trader based in the United Kingdom ("GiveGiftAid", "we", "us"). To investigate a problem, GiveGiftAid may view your workspace in a read-only support mode; this cannot change anything and each access is logged. GiveGiftAid is an independent service. It is not run, endorsed or approved by HMRC, and the name refers to the Gift Aid scheme, which charities claim through HMRC themselves. Contact: [email protected].
By connecting a GoCardless account to GiveGiftAid or using a charity dashboard, you agree to these terms on behalf of your organisation, and you confirm that you are authorised to do so.
2. What the service does
GiveGiftAid provides donation pages, campaigns, promotional tools, supporter records, regular-giving management and Gift Aid record-keeping, connected to your organisation's own GoCardless account.
- GiveGiftAid is not a payment service provider. Donations are paid through GoCardless directly into your GoCardless account. GiveGiftAid never receives, holds or pays out donated money.
- GiveGiftAid does not submit Gift Aid claims to HMRC, give legal, tax or fundraising advice, or check that your organisation is eligible to fundraise.
3. Your account
- Live workspaces connect your live GoCardless account and collect real donations.
- Sandbox workspaces connect a GoCardless Sandbox account for testing. They must not be used to ask for, collect or report real donations, and Sandbox results must not be presented as real fundraising.
- Live and Sandbox workspaces are separate. Data is not moved between them.
- You must keep your GoCardless account in good standing, and keep control of the email and sign-in details used for it, because GoCardless sign-in is how you access your dashboard. Tell us straight away if you think someone has accessed your account without permission.
4. Fees, billing and cancellation
| Charged by | What | How much |
| GiveGiftAid | Subscription for each live workspace, including donation pages, unlimited campaigns, the Creative Studio, supporter records, regular-giving tools and Gift Aid files | £5 per month. GiveGiftAid charges no set-up fee and no per-donation fee. |
| GoCardless | Payment processing (for example transaction fees on each payment and any fees for failed payments or chargebacks) | As set out in your agreement with GoCardless. These fees are separate from GiveGiftAid's subscription. |
- Sandbox workspaces are free.
- Billing. Your first month on a live workspace is free. Set up the £5 monthly Direct Debit from your dashboard during the free month; the first payment is collected when it ends, then monthly in advance. The £5 includes VAT at the standard rate, and an invoice for each payment is available in Account & data. The Direct Debit is with GiveGiftAid and is separate from your GoCardless account and your donations.
- Price changes. We will give you at least 30 days' notice of a price change. You can close your account before it takes effect.
- Cancellation. You can cancel at any time by closing your account in Account & data in your dashboard, or by contacting us. The subscription ends at the end of the billing month you are in, and we don't refund part-months unless the law requires it. Download your data before closing (see section 11).
- Unpaid fees. If a payment fails, or there is no Direct Debit in place when a payment is due, we will tell you in your dashboard. If it is still unpaid 14 days later, your donation page and website widgets go offline until it is paid. You can still log in to pay, download your data and manage supporters, and your supporters' existing Direct Debits with you are not affected.
- GoCardless bills its fees to you directly. GiveGiftAid does not set, collect or refund GoCardless fees.
5. GoCardless and donations
- Your use of GoCardless is governed by your own agreement with GoCardless, including payouts, fees, verification, chargebacks and the Direct Debit Guarantee. GoCardless may limit or close your GoCardless account under that agreement. We can't override its decisions.
- Donors authorise payments on pages hosted by GoCardless and their bank. GiveGiftAid shows each payment's status as GoCardless reports it.
- GiveGiftAid accepts donations only while GoCardless reports your account as verified and able to take payments.
- Each donation is a gift from the donor to your organisation. You are responsible for how donations are used and for any promises your appeal makes.
6. Refunds, failed payments and disputes
- Refunds. Whether to refund a donation is your decision, subject to the law and the Direct Debit Guarantee. You can refund through GoCardless from your dashboard or in GoCardless. Refunds come from your GoCardless balance, not from GiveGiftAid.
- Failed payments and chargebacks. GoCardless handles failed payments, Direct Debit indemnity claims and chargebacks under your agreement with it. GiveGiftAid updates the donation's status and, where Gift Aid was already claimed, flags the correction to make. GiveGiftAid is not responsible for money that is reversed, returned or not collected.
- Disputes with donors about a donation, refund or Gift Aid are between you and the donor. We'll give you the records we hold to help resolve them.
- Disputes with us. Please contact us first at [email protected] so we can try to resolve the problem.
7. Gift Aid
You are responsible for your Gift Aid claims, including checking that each donor and donation is eligible, that declarations are valid, submitting claims to HMRC, correcting earlier claims, and keeping records for as long as HMRC requires. GiveGiftAid's Gift Aid tools help you record declarations and prepare claim files from the information donors and GoCardless provide. They do not guarantee that a claim is correct or will be accepted.
8. Your responsibilities
You must:
- be a charity or other organisation lawfully able to fundraise, and give accurate information about it;
- make sure your appeals and pages are truthful, comply with fundraising law and the Code of Fundraising Practice where it applies, and don't infringe anyone's rights;
- comply with data protection law for the supporter information you control, including telling supporters how you use their information;
- keep supporter notes relevant and respectful, and not record special category information (such as health or religious beliefs) unless you have a lawful basis to do so;
- not misuse GiveGiftAid, try to access other accounts or data, interfere with its security, or use it for anything unlawful or fraudulent.
9. Data protection
For supporter, donation and Gift Aid information, you are the controller and GiveGiftAid is your processor. GiveGiftAid is the controller of the information about your account users and of information used to keep the service secure. Our privacy policy explains this in more detail. As your processor, we will:
- process supporter information only to provide GiveGiftAid to you and on your documented instructions (these terms and your use of the dashboard are your instructions), unless the law requires otherwise;
- make sure anyone who processes it for us is bound by confidentiality;
- protect it with appropriate technical and organisational security measures, as described in the privacy policy;
- use Cloudflare, Inc. as a sub-processor for hosting and database storage, and tell you before adding or replacing a sub-processor so you can object;
- help you respond to requests from people exercising their data protection rights, and with security, breach notification and data protection impact assessments, taking into account the information available to us;
- tell you without undue delay after becoming aware of a personal data breach affecting your supporters;
- delete your supporter information when you close your account (you can download it first), except where the law requires us to keep it;
- give you the information you reasonably need to show that these obligations are being met.
GoCardless processes payment information under your agreement with GoCardless and its own privacy notice. It is not our sub-processor.
10. Availability and liability
- We aim to keep GiveGiftAid available and working properly, but we don't guarantee that it will be uninterrupted or error-free. We may need to pause it for maintenance or security, and it depends on services we don't control, including GoCardless, banks and Cloudflare.
- We are not liable for losses caused by those third-party services, by events beyond our reasonable control, or by incorrect information supplied by you, donors or GoCardless.
- We are not liable for loss of profits, donations, revenue, goodwill or data that you could have avoided by downloading your records, or for any indirect or consequential loss.
- Our total liability to you in any 12-month period is limited to the subscription fees you paid us in that period.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
11. Suspension and closure
- We may suspend your workspace, taking your donation page offline and signing users out, if fees are unpaid (see section 4), if we reasonably believe the account is being used fraudulently or unlawfully or puts donors or the service at risk, if you seriously breach these terms, or if the law requires it. Where it is safe and lawful, we will tell you why and give you a chance to put things right first.
- We may close the service, or your account, with at least 30 days' notice, or immediately for a serious breach that isn't put right.
- You can close your account at any time in Account & data. Closing it revokes GiveGiftAid's access to your GoCardless account and permanently deletes your workspace, supporters, donations and Gift Aid records from GiveGiftAid. Your payment history remains in GoCardless. Download your data first, particularly Gift Aid records you must keep for HMRC.
12. Your content
You keep ownership of the text, images and other content you add. You give us permission to store, display and adapt it (for example resizing images) as needed to run your pages and the service. You confirm you have the right to use it. We own GiveGiftAid's software, design and branding.
13. Changes to these terms
We may update these terms. For changes that materially affect you, we will give at least 30 days' notice by email or in your dashboard, and you can close your account before they take effect. Continuing to use GiveGiftAid after that means you accept the updated terms.
14. General
- These terms are the whole agreement between you and us about GiveGiftAid.
- If any part is found unenforceable, the rest still applies.
- You may not transfer your rights under these terms without our consent. We may transfer ours to someone who takes over the service, and we will tell you if we do.
- Nobody else has rights under these terms under the Contracts (Rights of Third Parties) Act 1999.
- These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
15. Donors and visitors
- When you donate through a GiveGiftAid page, your donation is made to the charity named on the page, and you authorise the payment through GoCardless and your bank. GiveGiftAid doesn't receive your money.
- For questions about a donation, refunds or Gift Aid, contact the charity. Direct Debits are protected by the Direct Debit Guarantee.
- Gift Aid is optional. Only make a declaration if you are a UK taxpayer and understand that you must pay at least as much Income Tax or Capital Gains Tax as all charities and community amateur sports clubs will reclaim on your donations in that tax year.
- Please don't misuse the website or try to access it in ways it isn't designed for.
